Bankruptcy FAQs

Bankruptcy Hearing

You must appear at the hearing.  You will receive notice of bankruptcy within a week of filing.  If you don=t receive notice, please call me.  It gives the date, time, and location of the hearing.  There is a $75 rescheduling fee for missing the first hearing.  The penalty for missing the second hearing is dismissal of your case.

Bankruptcy is a federal court proceeding.  Please dress accordingly.  I have seen the judge send people home for a change in clothing.

The trustee has 3 jobs at the hearing:

  1. Identify you by social security card and driver's license.

  2. Verify the truthfulness of the petition.

  3. Find assets for the benefit of creditors.

I apologize for my memory.  Since I see my clients a month before the hearing, I can=t always remember people=s names or faces.  Some of my clients don=t even remember me, so I have included my picture.  Please feel free to introduce yourself to me at the hearing.
