Checking Accounts

If you owe money to your bank or credit union and wish to file against a debt owed to them, close out all checking and savings accounts before you see me.

If you do not owe money there, don't close them out. If you have voluntary payments taken out of your checking account or payroll check, you must call the bank or payroll department to stop them. Just filing bankruptcy may not do this.

Credit Unions have greater rights than banks.  Every debt is secured by every asset the credit union holds.  Credit Unions can freeze your accounts and cancel your membership if you cause them loss.

If you owe money to a credit union reduce the balances in all your accounts in it, including children’s accounts.

Important: The trustee will ask for a bank statement coving the date of filing and may be interested in taking the cash you had that day unless we can exempt it.
